Terms of Service

Last updated: October 2026

1. ABOUT PIXMO

These Terms of Service ("Terms") govern your access to and use of Pixmo, including getpixmo.com and Pixmo's AI-powered image, video, editing, analysis and related services ("Services").

Pixmo ("Pixmo", "we", "us" or "our") is operated by the Australian company named at the bottom of this page.

By creating an account, purchasing credits or using the Services, you agree to these Terms and our Acceptable Use Policy and acknowledge our Privacy Policy.

If you do not agree, do not use the Services.

2. ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to create an account or use the Services. By creating an account, you confirm that you meet this requirement.

You must be legally capable of entering into this agreement and meet any minimum-age requirements applicable to the Services in your jurisdiction.

If you use the Services on behalf of a business or other entity, you confirm that you have authority to bind that entity to these Terms.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.

You must provide accurate account information and notify us if you reasonably believe your account has been compromised.

3. PIXMO SERVICES

Pixmo provides AI-powered creative tools that may include text-to-image, image generation, text-to-video, image-to-video, reference-to-video, video-to-video, video analysis, video recreation, editing, character/reference tools and other AI-powered functionality.

Features, models, generation limits, pricing and availability may change over time.

Some Services depend on third-party artificial intelligence models, APIs and infrastructure.

4. USER INPUTS

"Inputs" include prompts, photographs, images, videos, audio, reference material, files, instructions and other content submitted to Pixmo.

You retain any rights you already hold in your Inputs.

By submitting an Input, you grant Pixmo a limited, non-exclusive licence to host, transmit, reproduce, process, modify and otherwise use the Input as reasonably necessary to provide, secure, moderate, maintain and operate the Services and fulfil your requested generation or editing operation, subject to our Privacy Policy.

You represent and warrant that you have all rights, licences, permissions and consents required to submit and use your Inputs through Pixmo.

Uploading material to Pixmo does not give you ownership of third-party material or additional rights in that material.

5. REFERENCE VIDEOS AND VIDEO RECREATION

Pixmo may provide functionality that analyses reference videos or other media and identifies elements such as scenes, dialogue, pacing, camera direction, composition, actions and other characteristics to assist users in creating new content.

You must own the reference material or have the rights, licences or permissions necessary for your intended use.

Pixmo's ability to technically analyse, transform or generate content from an Input does not mean that the Input or resulting use is legally authorised.

You remain responsible for determining whether you have the right to reproduce, adapt, publish, distribute, commercially exploit or otherwise use material submitted to or generated through the Services.

6. REAL PEOPLE AND LIKENESSES

If an Input contains the face, likeness, voice or other identifiable characteristics of another person, you represent and warrant that you have obtained any rights, permissions, releases or consents required for your intended use.

You must not use Pixmo to unlawfully exploit another person's identity, violate privacy or personality rights, facilitate fraud, deceptively impersonate another person, harass another person, or otherwise violate our Acceptable Use Policy.

The fact that a photograph, video or other depiction is publicly available does not itself mean that you have all rights necessary to use it.

You must not use the Services to identify, verify or authenticate any individual, or submit biometric identifiers or templates (such as faceprints or voiceprints). Submitting ordinary photos, videos or audio containing a face or voice for features that rely on them is permitted, subject to this section.

You must not create, upload or share sexual or intimate imagery of a real person without their consent, or any sexual content involving or depicting a minor. A person depicted in intimate imagery made through the Services without consent (or their authorised representative) may request its removal through our Copyright & Reporting page. Pixmo will remove validly reported non-consensual intimate imagery, and known identical copies, within 48 hours of receiving a valid request.

7. AI-GENERATED OUTPUTS

"Outputs" are images, videos, text or other material generated through the Services.

To the extent permitted by applicable law and subject to third-party rights and applicable provider terms, Pixmo does not claim ownership of Outputs generated for you.

AI generation is probabilistic. Outputs may be inaccurate, unexpected, incomplete, similar to content generated for other users or may not precisely follow a prompt.

Pixmo does not guarantee that an Output is unique, eligible for intellectual-property protection, free from third-party rights or suitable for a particular commercial or legal purpose.

You are responsible for reviewing Outputs and determining whether your intended use is lawful before publishing, distributing, selling or otherwise using them.

Where required by applicable law or platform rules, you must disclose that an Output is AI-generated or AI-altered, and you must not remove or obscure any provenance markers or labels Pixmo applies to Outputs.

8. THIRD-PARTY AI SERVICES

Pixmo may use third-party AI models, APIs, infrastructure and service providers to perform requested generations and processing.

Inputs, prompts and other information required to fulfil a request may therefore be transmitted to applicable providers as described in our Privacy Policy.

A request may be processed by more than one provider. If one provider cannot complete a request, Pixmo may send it to another provider to complete it, at the same credit cost.

Availability, moderation, technical limitations and output behaviour may depend partly on those providers.

Pixmo does not guarantee the continuous availability of any particular AI model or third-party service.

9. USE THROUGH AI ASSISTANTS AND INTEGRATIONS

Pixmo may let you connect your account to third-party AI assistants or tools (for example, through an MCP connector) so they can create content and use credits on your behalf.

When you connect a third-party assistant or tool, you authorise it to act through your account. You are responsible for actions taken and credits used through tools you connect, and for complying with those tools' own terms.

You can disconnect a connected tool at any time. Pixmo is not responsible for the operation of third-party assistants or tools.

10. CREDITS AND PAYMENTS

Certain Pixmo Services require credits.

The number of credits required may depend on the model, resolution, video duration, generation type and other selected parameters.

The applicable credit cost will be displayed through the Service where reasonably practicable.

Credits included with a subscription plan are added each billing period and reset at renewal; unused plan credits do not roll over.

Credits purchased separately as one-time credit packs do not expire and remain in your account if you cancel your subscription, unless your account is terminated for a breach of these Terms.

Credits have no cash value and cannot be transferred or redeemed for cash except where required by law.

Pricing and credit requirements may change prospectively.

Purchasing Pixmo credits does not purchase ownership of any underlying AI model, software or technology.

Payments are processed by our third-party payment provider (Stripe). Prices are shown in US dollars unless stated otherwise. You are responsible for any taxes that apply to your purchase, which may be added at checkout where required by law.

11. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

Subscriptions are billed in advance, monthly or yearly depending on the billing option you choose. Your subscription automatically renews at the end of each billing period at the then-current price for your plan until you cancel. Yearly plans are billed once a year and include your plan's credits each month. By subscribing, you authorise Pixmo (through our payment provider) to charge your payment method at the start of each billing period.

If the price of your plan changes, we will notify you before the new price applies to your next renewal, and you may cancel before then.

You can cancel at any time in Settings → Manage subscription, or by contacting us from the email address on your account. After cancelling, your plan stays active until the end of the current billing period and will not renew after that.

Upgrades take effect immediately: you are charged the difference between the two plan prices for the current period and receive the difference in plan credits, and your billing date stays the same. Downgrades take effect from your next renewal.

If a renewal payment fails, we may retry the charge and may suspend or cancel your subscription until payment is received.

Subscriptions bought in the Pixmo iPhone app are sold and billed by Apple through your Apple ID, at the prices shown in the app (which may differ from prices on our website). They renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your Apple ID is charged for renewal within 24 hours before the period ends. You can manage or cancel them in your Apple ID account settings (iPhone Settings → your name → Subscriptions). Plan changes and cancellations for these subscriptions are made through Apple, not in Pixmo's website settings.

12. REFUNDS

Except as set out in these Terms or where required by law, payments are non-refundable, including for partial billing periods and unused credits. Pixmo may issue refunds at its discretion.

Nothing in this section limits your rights under the Australian Consumer Law. If the Services have a major failure, you may be entitled to a refund or other remedy under that law.

Refunds for purchases made through the Apple App Store are handled by Apple under Apple's refund policies (reportaproblem.apple.com). Pixmo cannot issue refunds for App Store purchases.

If you are a consumer in the European Economic Area or the United Kingdom, you may have a statutory right to withdraw from a purchase within 14 days. Because the Services are digital and begin immediately, by using credits or the Services during that period you request immediate performance and, to the extent permitted by law, acknowledge that your right of withdrawal ends for the portion already supplied.

13. FAILED GENERATIONS

AI generations can occasionally fail because of technical errors, provider outages, safety filtering, unsupported inputs or other circumstances.

Where Pixmo determines that credits were charged for a generation that failed due to a technical failure for which credit restoration is appropriate, Pixmo may restore the applicable credits.

A generation that successfully completes but produces an Output that a user subjectively dislikes is not necessarily a failed service.

Nothing in this section limits rights that cannot lawfully be excluded.

14. ACCEPTABLE USE

You must comply with Pixmo's Acceptable Use Policy.

Pixmo may block a generation, remove or restrict content, restrict functionality, suspend an account or terminate an account when reasonably necessary to enforce our policies, protect users or third parties, comply with third-party provider requirements or comply with applicable law.

15. PIXMO INTELLECTUAL PROPERTY

Pixmo and its licensors retain their rights in the Pixmo website, software, interface, branding, logos, underlying technology and other materials provided by Pixmo, excluding User Inputs and Outputs to the extent described in these Terms.

You may not unlawfully copy, reverse engineer, interfere with, scrape, circumvent or exploit the Services.

If you send us ideas, suggestions or other feedback, we may use it without restriction or payment to you.

16. COPYRIGHT AND RIGHTS COMPLAINTS

If you believe content associated with Pixmo infringes your copyright, privacy, likeness or other rights, use the process described on our Copyright & Reporting page.

Pixmo may remove or restrict relevant content while investigating a complaint and may suspend users responsible for serious or repeated violations.

17. CONTENT STORAGE AND ACCOUNT DELETION

Pixmo stores your Inputs and Outputs to provide the Services, but does not guarantee that they will be stored indefinitely. You should download and keep copies of Outputs you want to keep.

You can delete your account at any time in Settings → Delete account (in the app or on the website), or by contacting us. When your account is deleted, your content will be removed from active use within a reasonable period, except where we must retain information to comply with law, resolve disputes, prevent abuse or enforce these Terms. Unused credits are forfeited on deletion except where required by law.

18. SUSPENSION AND TERMINATION

Pixmo may suspend or terminate access where we reasonably believe an account has materially or repeatedly violated these Terms, the Acceptable Use Policy, applicable law, third-party provider requirements or the rights of others.

Where reasonably practicable, we may provide notice.

Serious abuse, fraud, unlawful content, child exploitation, attempts to circumvent safety systems or urgent legal or safety concerns may result in immediate action.

If your account is terminated for a serious violation, you may not create a new account without our permission.

19. DISCLAIMERS

To the maximum extent permitted by law, the Services and AI Outputs are provided on an "as available" basis.

AI systems may produce unexpected or inaccurate results and third-party services may experience interruptions.

Nothing in these Terms excludes guarantees, warranties, rights or remedies that cannot lawfully be excluded.

20. AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted or modified.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Pixmo is not liable for indirect, incidental, special or consequential loss arising from use of the Services where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights and remedies that cannot be excluded under the Australian Consumer Law.

22. INDEMNITY

To the extent permitted by law, you agree to indemnify Pixmo against third-party claims, losses, liabilities and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or Inputs you submit that infringe another person's rights.

This does not apply to the extent a claim or loss was caused by Pixmo's own unlawful conduct, negligence or breach of obligations that cannot lawfully be excluded.

23. CHANGES

Pixmo may update these Terms to reflect changes to the Services, providers, business practices or applicable law.

Material changes will apply prospectively and notice will be provided where required by law.

24. GENERAL

Electronic communications: you agree that notices and other communications we send electronically (by email or through the Services) satisfy any legal requirement that they be in writing.

Assignment: you may not transfer your account or rights under these Terms without our consent. We may assign these Terms in connection with a merger, sale of business or reorganisation.

Events outside our control: we are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of third-party providers, internet failures or natural disasters.

Severability and waiver: if any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.

Entire agreement: these Terms, together with our Acceptable Use Policy and Privacy Policy, are the entire agreement between you and Pixmo about the Services.

25. GOVERNING LAW

These Terms are governed by the applicable laws of Australia, subject to mandatory rights available under applicable law.

26. APPLE APP STORE

If you downloaded the Pixmo iPhone app from the Apple App Store, the following also applies. These Terms are between you and Pixmo only, not Apple. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation for the app; if the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that the app or your use of it infringes a third party's intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must also comply with Apple's Usage Rules and any applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
